Welcome to Wolf Phases ("Wolf Phases," "we," "our," or "us"). These Terms of Use and Sales Agreement ("Terms") govern your access to and use of this website, including all purchases made through it.

By accessing this website, browsing its content, or purchasing artwork, you agree to be bound by these Terms. If you do not agree, please do not use this website.

1. Ownership of Website Content

Unless otherwise stated, all artwork, photographs, digital images, videos, text, logos, graphics, designs, layouts, and other content on this website are the intellectual property of Whitney William Wolf II or are used with permission.

These materials are protected by United States and international copyright, trademark, and intellectual property laws.

No content may be copied, reproduced, modified, distributed, published, sold, or used for commercial purposes without prior written permission.

2. Purchase of Artwork

Purchasing artwork transfers ownership of the physical artwork only.

Unless expressly stated in a written agreement signed by the copyright owner, no copyright or reproduction rights are transferred with the sale.

The artist retains all rights to:

  • Copyright

  • Reproduction

  • Licensing

  • Publishing

  • Merchandising

  • Digital display

  • Future print editions

  • Exhibition rights

Collectors may display purchased artwork for personal enjoyment but may not commercially reproduce or distribute images of the artwork without written permission.

3. Limited Collections

Certain collections may be created from rare, historic, reclaimed, or otherwise limited materials.

When such materials are exhausted, additional works from those materials may no longer be available. Availability is not guaranteed.

4. Product Images

We strive to present artwork as accurately as possible.

Because of differences in monitors, mobile devices, lighting conditions, and photography, colors, textures, finishes, and appearance may vary slightly from what appears on your screen.

These differences do not constitute defects.

5. Handmade Nature of Artwork

Many works offered through Wolf Phases are original handmade artworks.

Minor variations, natural material characteristics, and subtle imperfections are part of the artistic process and should not be considered manufacturing defects.

6. Pricing

Prices are subject to change without notice.

Artwork prices may increase or decrease based upon exhibitions, market demand, availability, artist decisions, or other factors.

Price changes do not affect completed purchases.

7. Shipping

Shipping dates are estimates only.

While we make every reasonable effort to package artwork professionally and securely, delays caused by carriers, weather, customs, labor disruptions, or other events beyond our control are not our responsibility.

Risk of loss transfers to the purchaser upon delivery by the carrier unless otherwise required by applicable law.

8. Inspection Upon Delivery

Customers should inspect all shipments immediately upon delivery.

If visible shipping damage exists:

  • Photograph the unopened package before opening.

  • Photograph all packaging materials.

  • Photograph the artwork.

  • Retain all packaging.

  • Notify both the shipping carrier and Wolf Phases as soon as reasonably possible.

Failure to preserve packaging or document damage may affect available remedies through the shipping carrier.

9. Returns

Unless otherwise stated in writing, original artwork sales are final.

Returns, exchanges, or refunds are not guaranteed and are reviewed on a case-by-case basis.

Nothing in these Terms limits any non-waivable consumer rights that may apply under applicable law.

10. Availability

Because original artwork is one of a kind, inventory may occasionally become unavailable due to simultaneous sales, exhibitions, or other circumstances.

If artwork becomes unavailable after purchase, our liability is limited to refunding the purchase price paid.

11. Website Availability

We do not guarantee uninterrupted access to this website.

The website may be modified, suspended, or discontinued without notice.

12. User Conduct

You agree not to:

  • Attempt to interfere with website security.

  • Upload malicious software.

  • Use automated systems to scrape or harvest website content except as permitted by applicable law.

  • Misrepresent your identity.

  • Violate applicable laws while using the website.

13. Artificial Intelligence & Data Mining

Except where prohibited by applicable law, the artwork, photographs, written materials, and other original content on this website may not be copied, downloaded in bulk, scraped, or used for training artificial intelligence systems, machine learning models, datasets, or similar technologies without prior written permission.

Wolf Phases does not control or endorse those websites and is not responsible for their content, policies, or practices.

15. Disclaimer

Artwork is offered "as is" except where warranties cannot legally be disclaimed.

To the fullest extent permitted by law, Wolf Phases makes no warranties, express or implied, regarding uninterrupted website availability, merchantability, fitness for a particular purpose, or non-infringement.

Historical, scientific, artistic, or educational information presented on this website is provided for general informational purposes and should not be considered professional advice.

16. Limitation of Liability

To the fullest extent permitted by law, Wolf Phases, Whitney William Wolf II, and their representatives shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to the use of this website or the purchase of artwork.

Where liability cannot be excluded by law, our total liability shall not exceed the amount paid by the customer for the applicable purchase.

Nothing in these Terms excludes liability that cannot legally be excluded under applicable law.

17. Indemnification

You agree to indemnify and hold harmless Wolf Phases, Whitney William Wolf II, and their representatives from claims, damages, liabilities, costs, and expenses arising from your misuse of the website or your violation of these Terms, to the extent permitted by law.

18. Governing Law

These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.

Any legal dispute arising from these Terms shall be brought in the appropriate state or federal court located in Florida, unless applicable law requires otherwise.

19. Severability

If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.

Wolf Phases may revise these Terms at any time.

Updated Terms become effective upon posting to this website. Continued use of the website constitutes acceptance of the revised Terms.
